On 4 May 2010, European Commission published a draft proposal of revised rules for the assessment of horizontal cooperation agreements between competitors. The pro-competition benefits of these arrangements such as innovation and competitiveness are underlined since they are fundamental to the new Commission's Europe 2020 strategy. These pro-competition effects on the markets must be self-assessed following a new Commission approach which abolished the former notification system under which companies had to notify their horizontal cooperation agreements to the Commission, which had the sole power to grant an exemption. Nowadays, companies need to self-assess whether an agreement infringes Article 101(1) TFEU and, if so, whether the exemption conditions of Article 101(3) TFEU are met.
